BURDEN OF PROOF
--> responsibility of providing evidence to prove a claim
It is simply a burden that is put on prosecutor to prove that a person is guilty.
Ex. if a person is innocent. It is up to the accuser to provide evidence that proves that the other person is guilty therefore the burden of proof lies on the accuser.
The police can take more actions depending on how much information or proof they have.
-->The police can stop a person and ask them questions with a reasonable suspicions
--> With probable cause the police can arrest an individual
--> A person can be found guilty by a preponderance of evidence (51%) in a civil court.
--> A person can be found guilty in a criminal court beyond a reasonable doubt.
Therefore the more proof the police has the more freedoms they can take from the accused. The punishment get severe with more proof.
